Thinking About Current Legal Issues Describe the Issue: The Ontario and federal governments are both considering implementing restrictions on people who have not received the Covid-19 vaccine. Many people are outraged, claiming that it is their right to choose not to get it. The government claims that by not receiving the vaccine people are endangering themselves and others. The main question is whether or not the government should be allowed to implement restrictions on the unvaccinated. Connect the issue to at least TWO legal thinking concepts:

  1. Legal Significance: A law implementing restrictions on people who are unvaccinated affects a large portion of the population and possibly means taking away some of their Charter rights. This could set a precedent allowing the government to limit people’s rights for other things in the future. On the other hand, people who are not vaccinated could be considered a danger to society by being carriers of the virus and may infect and harm others. This case is significant because it sets an important precedent and affects a large part of our population.
  2. Legal Perspective: A member of the justice community may look at Section 7 of the Charter, which guarantees life, liberty and security of the person. After review of the issue they would look at a precedent case such as vaccines which are already mandated in schools. The other thing they would consider is that the government is not forcing vaccinations. They are merely limiting the activities in which unvaccinated individuals may participate. This means that the mandates are not a direct violation of Section 7 and would most likely be considered legal. Reflect on the issue: When I reflect on this issue personally I’m torn about what the right decision is. I think that people should get the vaccine and that there should be some restrictions on people who do not get the vaccine. I also think that there are many circumstances in society where people’s

Charter rights are violated for the good of the community, (Seen as laws in general restrict some of your freedoms) but the precedent that this sets allows the government more control on restricting people's freedoms and could allow them to do this in the future for smaller issues or for politically motivated reasons.
