Module 5: Other Law Enforcement Agencies

BUREAU OF FIRE PROTECTION:

TO SAVE LIVES AND PROPERTIES Every year, about 1,000 new firefighters are joining the Bureau of Fire Protection team or BFP in the Philippines. These new firefighters undergo a 4 – month extensive training at the National Fire Training Institute at the Camp Gen. Vicente Lim in Calamba, Laguna. According to Chief Inspector Inspian Manalo, not all aspirants to become firefighters make it to the team. Here are few of the requirements before joining

BFP:

College Graduate (with eligibility)

Height requirement of 5’4’’ (male) and 5’2’’ (female)

Note: need to a waiver for being a member of the cultural minority if these requirements are not met.

Age requirement of at least 30 years old In 2017, there are only about 28,000 firefighters for 100 million Filipinos. The bureau is working on hiring about 2 thousand or more to fill the lacking of 20,000 thousand in the next 5 years. The agency can only train about 900f firefighters per batch. They are given basic firefighting technique and emergency or rescue response techniques.

Police Discretion ➢ One of the most important powers vested by law to the police officers; ➢ It is defined as an authority conferred by law to act in a certain condition or situation in accordance with an official or an official agency’s own considered judgment and conscience; and ➢ It is defined as the wise use of one's judgment, personal experience to decide a particular situation. It is the freedom to make a choice among possible course or courses of action or inaction.

Note: One decision that is difficult for a police officer to make is whether to use force against a civilian, a decision that must be made quickly and often under stressful and ambiguous circumstances.

Criminal Investigation

  • It is an art which deals with the identity and location of the offender and provides evidence of his guilt through criminal proceedings.
  • It is the most difficult and complicated function of the police as criminal investigation
  • It is the collection and analysis of facts about persons, things, places, subject of a crime to identify the perpetrato, to locate his whereabouts and to gather evidence for the establishment of his guilt in a criminal proceeding.

Elements of Investigative Processes ➢ Recognition - It is the identification of information related or has in anyway bearing to the crime under investigation. ➢ Collection - It is gathering information related to the crime under investigation. ➢ Preservation - It is keeping of information gathered to ensure its physical and legal integrity. ➢ Evaluation - It is ascertaining whether information identified, collected and preserved can stand prosecution and trial.

Phases of Criminal Investigation – Arresting Offender 1. Identification of criminal offender 2. Tracing, locating and arrest of the offender 3. Gathering of evidence to prove his guilt in the criminal proceeding 4. Serving warrant of arrest 5. Conducting the arrest ARREST: Criminal Apprehension  It is taking of a person into custody in order to answer for the commission of an offense.  It is the most controversial yet critical function of a police officer during encounters with offenders. Two modes of arrest: 1. By the actual restraint of the person to be arrest 2. By his submission to the custody of the person making the arrest

Methods of Arrest under Rule 113 :  With warrant by Police Officer (Sec 7)  Without warrant by Police Officer (Sec 8)  Arrest by Private Person (Sec 9)

Note: No violence or unnecessary FORCE shall be used in any arrest. An act of arrest shall not be subjected to any greater restraint than is necessary.
